Senate Delays CLARITY Act Vote Until September

The U.S. Senate will not vote on the CLARITY Act before lawmakers leave Washington for their August state work period, ending a late effort to advance the crypto market structure bill this week.

Senate Majority Leader John Thune’s office confirmed that no August vote would be held and said the legislation would be queued when senators return. The Senate’s scheduled state work period runs from August 10 through September 11, placing its return on September 14.

Thune Ends Pre-Recess Push as No Cloture Motion is Filed 

Senator Cynthia Lummis and Senate Banking Committee Chair Tim Scott had pressed leadership to begin floor consideration before the break.

Scott said on August 6 that the Senate still had time to hold an initial vote before leaving. Lummis had argued that senators could remain through the weekend to complete work on CLARITY and other legislation.

The effort ended as leadership prioritized government funding legislation, a Russia sanctions measure, nominations, and other pending business. The official Friday floor agenda listed a series of votes but no action on CLARITY. No cloture motion had been filed for the bill.

The next procedural question is when Thune files for cloture. Depending on the timing, the first vote could occur as early as September 15 or September 16.

Ethics, Enforcement, and Stablecoin Rewards Remain Unresolved 

The delay gives negotiators more time to address Democratic objections involving ethics for public officials, consumer protection, illicit finance, conflicts of interest and market integrity.

Seven Democratic senators said in July that the current text remained insufficient but that negotiations would continue. Banking Committee Democrats have also raised concerns about decentralized finance, mixers, and law enforcement authority.

Stablecoin rewards remain another unresolved issue. Banking groups argue that yield-like payments offered through crypto platforms could draw deposits away from local lenders, while crypto companies say broad restrictions would reduce competition.

Senate Returns September 14 With 16 Days Before Funding Deadline 

The Senate Banking Committee advanced H.R. 3633 by a 15-9 vote on May 14, with Democrats Ruben Gallego and Angela Alsobrooks joining Republicans. That committee support does not guarantee the 60 votes generally needed to advance the legislation on the floor.

The Senate returns September 14, leaving 16 days before the September 30 government funding deadline. Any version passed by the Senate would also require further House action before it could reach President Donald Trump.

Thune has targeted September for the first vote, but no floor date has been announced. Negotiators must still resolve the ethics, enforcement and stablecoin-reward disputes before leadership commits time to the bill.
